1. Agreement to Terms

By accessing or using Car Seat Life LLC, doing business as CarSeatLife ("the Platform," "we," "us," or "our"), including our website at www.carseatlife.com and any associated mobile applications, you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

2. Description of Service

CarSeatLife is a child passenger safety platform that provides:

• Information Services: Car seat compatibility lookup (LATCH system), recall tracking and alerts, educational content, and child passenger safety resources.
• Marketplace Services: A platform connecting families ("Clients") with independent Certified Child Passenger Safety Technicians ("Educators") for car seat installation, inspection, and consultation services.
• Education Services: Safety classes and training sessions offered by CarSeatLife or taught by Educators acting as instructors.
• Premium Subscription: Enhanced features available through a paid subscription plan.

3. User Accounts

3.1 Account Creation

You must create an account to access most features. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

3.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized access or use of your account.

3.3 Age Requirement

You must be at least 18 years of age to create an account and use the Platform.

3.4 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any conduct we determine to be harmful to other users or the Platform.

3.5 Text Message (SMS) Reminders

CarSeatLife Appointment Reminders are optional text messages about upcoming appointments: for Clients, the appointments they book; for Educators, the appointments booked with them. By turning them on in the Profile tab of your account Settings, you agree to receive one reminder about 40 minutes before each confirmed appointment at the mobile number on your profile. Message frequency varies with your bookings. Consent is not a condition of any purchase. Message and data rates may apply. Reply STOP to cancel or HELP for help, or email support@carseatlife.com. Carriers are not liable for delayed or undelivered messages. See our Privacy Policy, Section 4.7.

4. Educator (Technician) Services

4.1 Independent Contractor Status

Educators listed on CarSeatLife are independent contractors and are NOT employees, agents, or representatives of CarSeatLife. CarSeatLife serves solely as a marketplace platform connecting Clients with Educators.

4.2 No Guarantee of Service Quality

While we require Educators to pass background checks, hold valid CPST certification, and maintain professional liability insurance, CarSeatLife does not guarantee the quality, safety, accuracy, or completeness of any services provided by Educators. You acknowledge that:

• CarSeatLife does not supervise, direct, or control Educators' work.
• CarSeatLife is not responsible for any actions, omissions, errors, or negligence of Educators.
• The selection and hiring of an Educator is entirely your decision and responsibility.

4.3 Educator Obligations

Educators using the Platform agree to:

• Maintain valid and current CPST certification with at least one completed recertification cycle.
• Affiliate with Car Seat Life LLC through Safe Kids Worldwide's Organization Management system.
• Consent to and pass an initial criminal background check and annual re-screening.
• Maintain professional liability insurance with minimum $1M/$2M coverage.
• Provide a valid government-issued photo ID for identity verification.
• Provide accurate information about their qualifications, services, and availability.
• Comply with all applicable laws and safety standards.
• Treat all clients with professionalism and respect.
• Agree to the Educator Services Agreement, which contains additional terms and obligations.

4.4 Verification and Suspension

CarSeatLife verifies Educators' CPST certification, background check status, and insurance coverage at onboarding and on an ongoing basis. Educator accounts will be automatically suspended if:

• CPST certification expires or is revoked.
• A background check reveals a disqualifying offense (as defined in the Educator Services Agreement).
• Professional liability insurance coverage lapses or cannot be verified.
• The Educator fails to cooperate with reverification requests within 14 days.

While CarSeatLife makes reasonable efforts to verify Educator qualifications, it is ultimately the Educator's responsibility to maintain all required credentials. CarSeatLife is not liable for any gaps in verification.

5. Payments and Billing

5.1 Premium Subscriptions

Premium subscriptions are billed on a recurring basis (monthly or annually) at the rates displayed at the time of purchase. You authorize CarSeatLife to charge your payment method on file for all applicable fees.

• Free Trial: New subscribers may receive a free trial period. You will be charged automatically at the end of the trial unless you cancel before it expires.
• Cancellation: You may cancel your subscription at any time through your account settings or the Stripe Customer Portal. Cancellation takes effect at the end of the current billing period. No prorated refunds will be issued for partial billing periods.
• Price Changes: We may change subscription pricing with at least 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.

5.2 Booking Payments

Payments for Educator services are collected at the time of booking through our payment processor, Stripe. Booking payments are split between the Educator and CarSeatLife as follows:

• 75% of the booking payment is remitted to the Educator.
• 25% is retained by CarSeatLife as a platform service fee.

Payment processing fees charged by Stripe are deducted from the total payment amount before the split is applied.

5.3 Class Enrollment Payments

Payments for safety classes are collected at the time of enrollment. Class fees are non-refundable unless the class is cancelled by CarSeatLife or the instructor.

5.4 Refund Policy

• Booking Cancellations: Cancellation and refund policies are set by individual Educators and displayed at the time of booking. CarSeatLife will process refunds in accordance with the applicable cancellation policy.
• Class Cancellations: If a class is cancelled by CarSeatLife or the instructor, enrolled users will receive a full refund.
• Subscription Refunds: No refunds are issued for subscription payments, including partial months or years.

5.5 Payment Processing

All payments are processed securely through Stripe, Inc. By using payment features, you also agree to Stripe's terms of service and privacy policy. CarSeatLife does not store credit card numbers or sensitive payment information on its servers.

6. Intellectual Property

6.1 CarSeatLife Content

All content, features, and functionality of the Platform — including but not limited to text, graphics, logos, icons, images, software, database compilations (including the LATCH compatibility database), educational materials, and the overall design and arrangement thereof — are owned by CarSeatLife or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.

6.2 Trademarks

"CarSeatLife," the CarSeatLife logo, and all related names, logos, product and service names, designs, and slogans are trademarks of CarSeatLife. You may not use such marks without our prior written permission.

6.3 Database Protection

The CarSeatLife LATCH compatibility database, recall database, and other compiled datasets represent substantial investment of time, effort, and resources. You may not copy, scrape, harvest, reproduce, republish, or redistribute any database content from the Platform, whether manually or through automated means, without our express written consent.

6.4 User Content

By submitting content to the Platform (including reviews, photos, and profile information), you grant CarSeatLife a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute such content in connection with operating and promoting the Platform. Messages you send through the Platform's messaging feature are not public content: the license above covers them only as needed to store, deliver and review them as described in Section 8.1 and the Privacy Policy, and CarSeatLife will not publish them or use them to promote the Platform.

6.5 DMCA / Copyright Complaints

If you believe that content on the Platform infringes your copyright, please contact us at legal@carseatlife.com with the information required under the Digital Millennium Copyright Act (DMCA).

7. Prohibited Conduct

You agree NOT to:

• Use the Platform for any unlawful purpose or in violation of any applicable law.
• Misrepresent your identity, qualifications, or affiliation.
• Scrape, crawl, or use automated means to collect data from the Platform.
• Interfere with or disrupt the Platform's infrastructure or other users' access.
• Post false, misleading, defamatory, or fraudulent reviews or content.
• Attempt to reverse-engineer, decompile, or disassemble any part of the Platform.
• Use the Platform to compete with CarSeatLife or solicit Educators or users for a competing service.
• Upload malicious code, viruses, or any harmful technology.
• Use the Platform's messaging feature to harass, threaten or spam another user, or for any purpose unrelated to the booking or class the conversation belongs to.
• Engage in any of the circumvention activities described in Section 8 below.

8. Non-Circumvention and Platform Integrity

8.1 Non-Circumvention Policy

CarSeatLife invests significant resources in connecting Clients with qualified Educators. To protect the integrity of this marketplace, the following rules apply to ALL users (both Clients and Educators):

• Platform-Originated Relationships: When a Client and Educator are first connected through CarSeatLife (including through search results, profile views, bookings, or any communication facilitated by the Platform), all subsequent service transactions between those parties must be conducted through the Platform for a period of twenty-four (24) months from the date of their first interaction on the Platform.
• No Direct Payment Arrangements: Users may not arrange, solicit, or accept payments outside the Platform for services that fall within CarSeatLife's service categories (car seat installation, inspection, consultation, or related child passenger safety services) between parties who were connected through the Platform.
• No Contact Information Exchange for Circumvention: Users may not exchange personal contact information (phone numbers, email addresses, social media handles, or physical addresses) for the purpose of arranging services outside the Platform. Contact information shared for the purpose of completing a Platform-booked service (such as providing an address for an in-person appointment) may not be used to arrange future off-platform transactions.
• Platform Messaging: Once a booking or class enrollment exists, Clients and Educators communicate about it through the messaging feature of the Platform. Messages are stored by CarSeatLife, are visible to the Client and to the Educator currently assigned to the booking or class (for a class, an instructor assigned later sees the earlier messages), and may be reviewed by CarSeatLife to provide support, to investigate a report, or to enforce these Terms. Users should not include their own or another user's phone number, email address, social media handle or payment details, or links to outside booking or payment pages, in a message. CarSeatLife hides what looks like a phone number, email address, web link or messaging handle from the recipient (links to public safety agencies such as NHTSA are allowed), may mark such a message for review, and may act under Section 3.4 and, where it determines circumvention, under Section 8.4.

8.2 Educator-Specific Obligations

Educators additionally agree NOT to:

• Solicit any Client met through CarSeatLife to book services directly, off-platform.
• Provide business cards, personal websites, or alternate booking methods to Clients met through the Platform with the intent to circumvent Platform fees.
• Encourage or suggest that a Client cancel a Platform booking and rebook the same service outside the Platform.
• Recruit or solicit other CarSeatLife Educators to leave the Platform or join a competing service.

8.3 Pre-Existing Relationships

This non-circumvention policy does NOT apply to Client-Educator relationships that existed before both parties joined CarSeatLife. If an Educator had an established client relationship prior to the Platform, those parties may continue to transact directly. However, if such a relationship is claimed, Car Seat Life LLC reserves the right to request reasonable documentation.

8.4 Remedies for Circumvention

If Car Seat Life LLC reasonably determines that circumvention has occurred, it may, at its sole discretion:

• Recover lost fees: Invoice the Educator for the platform service fees (25% of estimated transaction value) that would have been earned on each circumvented transaction.
• Suspend or terminate accounts: Temporarily or permanently suspend the accounts of any users involved in circumvention.
• Withhold payouts: Withhold pending Educator payouts until the matter is resolved.
• Pursue legal action: Seek damages, injunctive relief, and recovery of reasonable attorney's fees.

The exercise of one remedy does not preclude the exercise of any other remedy.

8.5 Reporting Circumvention

Users are encouraged to report suspected circumvention to legal@carseatlife.com. Reports may be made anonymously. CarSeatLife will investigate all credible reports and take appropriate action.

9. Disclaimers

9.1 General Disclaimer

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 Safety Information Disclaimer

The safety information, compatibility data, and recall information provided through CarSeatLife is for informational purposes only and should not be considered a substitute for professional advice. While we strive for accuracy, we do not guarantee that all information is complete, current, or error-free.

Car seat installation and use is a safety-critical activity. Always consult your car seat manufacturer's manual, your vehicle owner's manual, and/or a certified technician for specific installation guidance.

9.3 LATCH Data Disclaimer

LATCH compatibility information is sourced from publicly available manufacturer data. Vehicle and car seat specifications may change. Always verify compatibility with current manufacturer documentation before installation.

9.4 Recall Information Disclaimer

Recall information is sourced from the National Highway Traffic Safety Administration (NHTSA) and manufacturer databases. There may be a delay between a recall announcement and its appearance on our Platform. Always check NHTSA.gov for the most current recall information.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAR SEAT LIFE LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR USE OF OR INABILITY TO USE THE PLATFORM.
• ANY SERVICES PROVIDED BY EDUCATORS THROUGH THE PLATFORM.
• ANY ERRORS OR INACCURACIES IN THE PLATFORM'S CONTENT OR DATA.
• UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA.
• ANY THIRD-PARTY CONDUCT ON THE PLATFORM.

IN NO EVENT SHALL CAR SEAT LIFE LLC'S TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID TO CAR SEAT LIFE LLC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless CarSeatLife, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:

• Your use of the Platform.
• Your violation of these Terms.
• Your violation of any applicable law or the rights of any third party.
• Any content you submit to the Platform.

12. Dispute Resolution

12.1 Governing Law

These Terms shall be governed by the laws of the State of California without regard to its conflict of law provisions.

12.2 Arbitration

Any dispute arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall take place in Stanislaus County, California.

12.3 Class Action Waiver

YOU AGREE THAT ANY CLAIMS SHALL BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

13. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy at www.carseatlife.com/privacy.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Platform or via email at least 30 days before they take effect. Your continued use of the Platform after changes become effective constitutes acceptance of the modified Terms.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and CarSeatLife regarding use of the Platform.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

15.3 Waiver

The failure of CarSeatLife to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

15.4 Assignment

You may not assign your rights under these Terms without our prior written consent. CarSeatLife may assign its rights without restriction.
